Who is making bad decisions within the corridors of power of the US Navy?
We reported yesterday that the Norfolk office of OSHA is investigating reported wholesale fouling of the groundwater at Naval Station Norfolk with asbestos. The OSHA investigation is in addition to probes being carried out by the US Navy’s own Inspector General (IG) and NAVFAC’s IG.You would think that neglecting the remediation of buildings containing asbestos in the roofing material would be enough of a screw-up for the Navy. Not so! To add insult to injury, yesterday’s local and national headlines carried the story of a Norfolk-based sailor with 17 years of service who is being hounded because …… now get this, because his wife began the crusade against the toxic levels of lead in Flint, Michigan’s drinking water. I know, I know, that sounds surreal doesn’t it? But, that is what is being reported by local and national news outlets.It seems that Mrs. Lee Anne Walters, wife of Dennis Walters, was the first person in Flint, Michigan to realize that something was terribly wrong with their drinking water. She reported her doubts to the EPA and waited and waited and waited. Eventually, the EPA confirmed everyone’s worst fears and issued an emergency order documenting that the lead levels in the drinking water at the Walters home were twice the level considered to be toxic waste.Both of her twin boys, now five years old, were showing skin rashes and signs of stunted growth. Every mother would do the right thing and attempt to solve the problem affecting her children’s health, correct? You would think that any right-thinking individual would line-up squarely with Mrs. Walters, correct? So why has the US Navy seemingly gone way out of its way to become ensnared in what can only result in a black eye for the US Navy? What sort of positive outcome can be envisioned by systematically harassing a family that has already suffered as much as the Walters have suffered? Why would the Navy choose to lecture the 17 year Navy veteran husband to "get his wife under control?" Where does the Navy think that the City of Norfolk is located, Saudi Arabia? No, it’s located in Virginia and citizens of this commonwealth have a history of making wrongs right and standing-up for those being persecuted unjustly. Certainly the Walters family is a victim of persecution by the US Navy. Why would they fabricate a tale as explicit with facts and documentation as they have provided the media?Why would the US Navy choose to send one of their veterans for psychiatric evaluations based on his wife crusading for clean drinking water? Official sources within the Norfolk office of OSHA have confirmed to helpcom.net that OSHA has begun a formal investigation into first-hand accounts of asbestos run-off from roofs in the Naval Munitions sector at Naval Base Norfolk.In an apparent effort to show decreased maintenance budgets for essential asbestos remediation, the civil service personnel with NAVFAC MIDLANT led by Captain E.M. Aaby as well as the Base Commander Captain Douglas Beaver have allowed the asbestos-laden roofs to weep asbestos contamination off the roofs and into the groundwater leading directly to the nearby Chesapeake Bay.Additionally, the roofing material containing asbestos has become so exposed over the last 20 years that winds off the Bay can actually propel asbestos-laden particles airborne. This toxic hazard can impact not only military service personnel and civilian employees on the base but also members of the general civilian population living around the perimeter neighborhoods in Norfolk. The toxic hazards posed by this asbestos seems to pale in comparison in the quest for lower operating budgets to enhance the chances for raises and career advancement for those in the chain-of-command at Naval Base Norfolk. You see, remediating a building that harbors asbestos costs big bucks and the Navy has chosen to simply ignore the threat to both the natural environment and people posed by the asbestos.First, to remediate a roof containing asbestos means hiring a private contractor certified to handle hazardous material. The contractor would then "tent" the entire building to prevent the escape of asbestos by any means of transmission away from the work site. The asbestos would then be hauled to a landfill certified to bury hazardous waste like asbestos.Speaking of the chain-of-command, the most important players in this tragedy seem to display a wanton disregard for President Obama’s Executive Order 13508—Chesapeake Bay Protection and Restoration. This EO was first published in 2009 and explicitly condemns any violations by military services of the air and water surrounding the Chesapeake Bay. The act stipulates that Captain Douglas Beaver is the individual charged with the enforcement of EO 13508. Several environmental groups have attempted to solicit information regarding the extent of buildings contributing to the toxic mess, but their efforts have been rebuffed by all.One thing that the inquiries seem to have impacted was the career of Mr. Jerry Haste, a 39 year Public Works Department chief who abruptly retired on 3 Oct 16, some 30 days after receiving the first email asking for a list of all buildings on base containing asbestos. Now that OSHA has begun their formal investigation, Mr. Haste should have taken the advice of my dear, departed grandmother who always cautioned that, "You can run, but you can’t hide."The OSHA investigation adds to the ongoing investigation by the Navy’s Inspector General Staff in DC, the NAVFAC Inspector General and the establishment of a Department of Justice file in DC.We will issue updates as they are received from OSHA or the Navy’s IG team on this environmental catastrophe. |

What the DOJ is attempting to do violate Apple’s civil rights under the 5th , 6th, and 14th amendments to the U.S. Constitution. Apple has a right to ask to be paid for the work if it wants to do it. It has the right to ask for a large deposit up front for its contracted work. It also has the right to ask for damages that will result to the demised value of its product. That value is in the feature that made its product desirable and allowed Apple to be ahead of the curve with its competitors will be gone. |

![]() Angie Summers of West Virginia Against Common Core with the help of the Thomas More Law Center is suing the state of West Virginia to challenge the constitutionality of the Common Core State Standards and the Smarter Balanced Assessment Consortium.ANN ARBOR, Mich., Nov. 9, 2015 /PRNewswire-USNewswire/ -- The Thomas More Law Center, a national public interest law firm based in Ann Arbor, MI, late last week, filed a lawsuit against West Virginia Governor Earl Tomblin and several state officials to stop the state's implementation of Common Core and its participation in the Smarter Balanced Assessment Consortium ("SBAC"). The lawsuit claims that West Virginia's funding and participation in Common Core violates the U.S. Constitution, as well as federal and state laws that prohibit the federal government from usurping control over public school education. The lawsuit was filed in the Kanawha Circuit Court in West Virginia on behalf of two West Virginia taxpayers.The Thomas More Law Center (TMLC) is co-counsel in the case with D. John Sauer of the James Otis Law Group based in St. Louis, MO. Two prominent West Virginia attorneys, Jeffrey Kimble and Ryan Kennedy of Robinson & McElwee, PLLC, are assisting as local counsel.TMLC's lawsuit seeks to stop West Virginia's payment of membership fees totaling over $1.5 million per year on the grounds that SBAC, to which West Virginia is a member, is an unconstitutional compact because it was never approved by Congress. The Compact Clause of the United States Constitution provides that "[n]o state shall, without the consent of Congress . . . enter into any agreement or compact with another state."West Virginia's SBAC membership agreement forces West Virginia schools to align their curriculum with Common Core. The two Plaintiffs named in the lawsuit, Angela Summers and Fred Dailey are prominent members of West Virginia Against Common Core and over the last two years have voiced deep concerns about their state's participation in Common Core.Summers has five grandchildren. She began her battle against Common Core in 2013 over the new Common Core aligned math being taught to her grandchildren. Her concerns grew as she became aware of the federal government's intrusion into local classrooms, federalized collection of student data, and the requirement of excessive testing. Summers says that the battle against Common Core is a battle "we cannot lose. If we lose, we will lose our children. If we lose our children, we will lose this nation."Dailey, who also has grandchildren, is an Environmental Engineer with a Master's degree. He worked as a Plant Manager for a major Chemical Manufacturing facility for 10 years prior to retiring. He explains one of his reasons for getting involved in the lawsuit, "I strongly believe that the education of our children is best done locally with choices made by parents, teachers, and locally elected Boards of Education."The Thomas More Law Center and Sauer filed a similar lawsuit on behalf of state taxpayers against North Dakota officials five months ago. A decision in that case is still pending.Both the North Dakota and West Virginia lawsuits follow the success of a previous lawsuit filed by Mr. Sauer, that stopped Missouri's implementation of Common Core. That case is currently on appeal. Comey, said on Friday that the additional scrutiny and criticism of police officers in the wake of highly publicized episodes of police brutality may have led to an increase in violent crime in some cities as officers have become less aggressive. With his remarks, Mr. Comey lent the prestige of the F.B.I., the nation’s most prominent law enforcement agency, to a theory that is far from settled: that the increased attention on the police has made officers less aggressive and emboldened criminals. But he acknowledged that there is so far no data to back up his assertion and that it may be just one of many factors that are contributing to the rise in crime, like cheaper drugs and an increase in criminals who are being released from prison. “I don’t know whether that explains it entirely, but I do have a strong sense that some part of the explanation is a chill wind that has blown through American law enforcement over the last year,” Mr. Comey said in a speech at the University of Chicago Law School. Mr. Comey’s remarks caught officials by surprise at the Justice Department, where his views are not shared at the top levels. Holding the police accountable for civil rights violations has been a top priority at the department in recent years, and some senior officials do not believe that scrutiny of police officers has led to an increase in crime. While the department had no immediate comment on Friday, several officials privately fumed at Mr. Comey’s suggestion. Among the nation’s law enforcement officials, there is sharp disagreement over whether there is any credence to the so-called Ferguson effect, which refers to the protests that erupted in the summer of 2014 in Ferguson, Mo., over a police shooting. In Oakland, Calif., for example, homicides are on the rise after two years of decline. But shootings are down, and the overall crime rate is about the same, said Oakland’s police chief, Sean Whent. “Our officers are very, very sensitive to the climate right now, but I haven’t seen any evidence to say our officers aren’t doing their jobs,” Chief Whent said. In Washington, homicides are also up, but violent crime and crime over all are down, said Lt. Sean Conboy, a police spokesman. “Trying to correlate it to a Ferguson effect, I don’t believe is appropriate,” Lieutenant Conboy said. After civil rights leaders and the Justice Department accused the Seattle Police Department of discriminatory policing and excessive force, the number of officer-instigated stops declined and crime ticked upward, said Kathleen O’Toole, the police chief. Chief O’Toole said it was up to police leaders to insist on reversing that trend. The critiques made the department better, she said. Crime is down this year, and her city has hosted police officials from places such as Baltimore wanting to understand why. “There’s never been as much scrutiny on police officers as there is now,” Chief O’Toole said. “We should embrace it.” But Mr. Comey said that he had been told by many police leaders that officers who would normally stop to question suspicious people are opting to stay in their patrol cars for fear of having their encounters become worldwide video sensations. That hesitancy has led to missed opportunities to apprehend suspects, he said, and has decreased the police presence on the streets of the country’s most violent cities. “I’ve been told by a senior police leader who urged his force to remember that their political leadership has no tolerance for a viral video,” Mr. Comey said, adding that many leaders and officers whom he had spoken to said they were afraid to address the issue publicly. “Lives are saved when those potential killers are confronted by a police officer, a strong police presence and actual, honest-to-goodness, up-close ‘What are you guys doing on this corner at 1 o’clock in the morning’ policing,” Mr. Comey said. “We need to be careful it doesn’t drift away from us in the age of viral videos, or there will be profound consequences.” But investigations by the Justice Department have given weight to the loudest criticisms of police behavior in Ferguson and elsewhere. Those inquiries have found that many officers unfairly singled out African-Americans for stops and arrests, and too often used force that was unjustified. Videos of deadly encounters with the police in cities such as Cleveland, New York and North Charleston, S.C., have fueled that criticism. More than his predecessors, Mr. Comey has used his position as one of the nation’s top law enforcement officials to bring attention to issues that state and local police departments are confronting. It is not clear what impact he will be able to have on the issue. He said that the remedies to the problem were not clear, and that law enforcement authorities needed to have better data about crime and shootings involving police officers. Mr. Comey, who was in Chicago for the annual conference of the International Association of Chiefs of Police, plans to address the issue with law enforcement leaders. In February, Mr. Comey delivered an unusually candid speech at Georgetown University about the difficult relationship between the police and African-Americans. Some officers, he said, scrutinize minorities more closely using a mental shortcut that “becomes almost irresistible and maybe even rational by some lights” because black men are arrested at much higher rates than white men. Mr. Comey said that without more reliable data, the task of identifying trends and remedies to fix them is far more challenging. He said state and local law enforcement officials were increasingly open to providing the F.B.I. with better data so it can more accurately chart trends. “ ‘Data’ is a dry word, but we need better data,” Mr. Comey said. “And people tend to tune out when you start to talk about it, but it’s important, because it gives us the full picture of what’s happening.” |
